SALT LAKE CITY (AP) A Utah ski area that is one of the last remaining U.S. ski resorts that prohibit snowboarding says a lawsuit challenging the ban demeans the Constitution and should be thrown out.
In a lawsuit filed in federal court in January, four snowboarders claimed Alta ski area’s ban violates the Constitution’s promise of equal treatment.
In their rebuttal filed late last week, Alta ski area lawyers say snowboarders’ citation of the 14th Amendment degrades the Constitution. Attorneys say an amendment that protected former slaves should not be used to shelter a group that participates in a particular winter sport.
The brief says skiers find Alta more peaceful, safe and enjoyable because they don’t have to worry about being hit by snowboarders who have a blind spot because of their sideways stance.
