Santa Clara employee files charge against union

A Cupertino pharmacist filed an unfair practice charge against the largest public employee union in California, for refusing his resignation.

The charge has been filed to the Public Employment Relations Board. According to the complaint, the plaintiff requested last November to resign from SEIU Local 521 as a full dues-paying member, but was rejected in January.

SEIU Local 521 refuses to comment on the case upon enquiry, and says that they are reviewing the charge with attorneys.

While California is a forced-union state, state laws state that workers have the right to refrain from formal union membership, but are still responsible to pay part of the unions dues.
